1. Introduction

Welcome to Well Rested Babies ("we", "us", or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

These terms apply to all visitors, users, and clients of Well Rested Babies, including those who access our website, purchase digital products, or engage our sleep consulting services.

2. About Our Services

Well Rested Babies provides professional virtual pediatric sleep consulting services for families with children aged 4–14 months. Our services include:

• Comprehensive sleep consultations (conducted via Zoom)

• Customized sleep plans (delivered as PDF documents)

• 14-day daily support via WhatsApp or email

• Follow-up calls within 12 months of purchase

• Digital resources and educational materials

Our services are non-medical in nature. Nothing we provide constitutes medical advice, diagnosis, or treatment. Always consult your pediatrician before making changes to your child’s sleep routine, particularly if health concerns exist.

3. Eligibility

By engaging our services or accessing our website, you confirm that:

• You are at least 18 years of age

• You have the legal authority to enter into this agreement on behalf of your family

• The information you provide to us is accurate and complete

• You have the authority and ability to implement the sleep plan with your child

4. Booking & Payment

4.1 Payment Policy

Full payment is required before any scheduled consultation begins. Work on your customized sleep plan will not commence until payment has been received and confirmed.

4.2 Pricing

Service fees are listed on our website and in your individual service agreement. Prices are quoted in Trinidad and Tobago Dollars (TT$) unless otherwise stated.

4.3 Accepted Payment Methods

We accept the payment methods listed on our website at the time of booking. Well Rested Babies reserves the right to update accepted payment methods at any time.

4.4 Disputed Payments & Chargebacks

If you have a concern about a payment or charge, you agree to contact us directly before initiating a chargeback or dispute with your payment provider. We will work in good faith to resolve any billing issues promptly.

Initiating a chargeback without first contacting us is a breach of these terms. Any costs incurred by Well Rested Babies as a result of a disputed payment (including fees charged by payment processors) may be recovered from the client.

5. Cancellation & Refund Policy

Refunds are available based on the notice provided before the scheduled consultation:

• 4–3 days prior to consultation: 75% refund

• 24–48 hours prior: 50% refund

• 0–24 hours prior: 25% refund

• After the consultation has taken place: No refund

Once your consultation has occurred, all fees paid are non-refundable, including the consultation fee under all circumstances.

Rescheduling or canceling with less than 24 hours’ notice may result in forfeiture of your session. Refund timelines are calculated from the original scheduled appointment time, not the time of cancellation.

6. Scope of Services & Extras

Each service package includes only the items specified in your service agreement. Requests for additional support, extra calls, extended follow-up, or services not included in your original package are not covered and will be charged separately.

If you require additional services beyond what was agreed upon, please contact us to discuss pricing before assuming any extra services are included.

7. Client Responsibilities

Your active participation is essential to the success of the sleep program. By engaging our services, you agree to:

• Review your customized sleep plan before implementation

• Ensure all caregivers in the household follow the plan consistently

• Provide accurate and complete information about your child’s routines, sleep patterns, and health

• Communicate consistently during your 14-day support period

• Adhere to safe sleep practices at all times (see Section 10)

• Initiate daily communication during the support period — it is your responsibility to do so

If communication stops for more than 72 hours without prior notice, services may be considered terminated without refund.

8. Support Period

Your 14-day support period runs consecutively from the agreed start date. Pauses or extensions to the support period require prior written approval from Well Rested Babies.

Follow-up calls included in your package must be redeemed within 12 months of purchase. Unused support days are non-transferable and non-refundable in the event of any change in your child’s circumstances, unless termination is initiated by Well Rested Babies (see Section 9).

9. Termination by Well Rested Babies

In rare circumstances, Well Rested Babies may terminate the agreement. Grounds for termination include, but are not limited to:

• Non-responsiveness for more than 72 hours without notice

• Unsafe sleep practices or failure to follow safety guidelines

• Abusive, threatening, or disrespectful communication

• Breach of any terms in this agreement

If Well Rested Babies terminates the agreement, unused support days will be refunded at TT$72.00 per unused day. The consultation fee is non-refundable under all circumstances.

10. Safe Sleep

The safety of your child is our highest priority. By engaging our services, you agree to follow the American Academy of Pediatrics (AAP) safe sleep guidelines at all times, including:

• Placing baby on their back to sleep

• Using a firm, flat sleep surface

• Keeping soft items (pillows, blankets, toys, loose bedding) out of the sleep space

• Avoiding unsafe bedsharing practices

• Following all safety guidelines for any products used

11. Intellectual Property

All materials produced by Well Rested Babies — including sleep plans, guides, templates, worksheets, website content, and any other resources — are the exclusive intellectual property of Well Rested Babies and Margaretha Grosberg.

You are granted a personal, non-transferable license to use materials for your own family’s private use only. You may not:

• Reproduce, copy, or duplicate any materials

• Share, distribute, or forward materials to third parties

• Sell, resell, or commercially exploit any portion of our services or products

• Use our content for coaching, consulting, or any professional service

Unauthorized use of our intellectual property may result in legal action.

12. Confidentiality

Well Rested Babies treats all client information with strict confidentiality. We will not share your personal or family information with third parties except as required by law.

With your explicit written consent, we may use anonymized, non-identifying results or testimonials for educational or promotional purposes. You may withdraw this consent at any time by contacting us in writing.

13. Disclaimer of Warranties

Well Rested Babies provides sleep consulting services based on evidence-based methods and professional experience. However, we cannot and do not guarantee specific outcomes, including:

• That your child will sleep through the night within any specific timeframe

• That results will be permanent or unaffected by developmental changes, illness, or regression

• That the plan will work identically for every child

Our services are provided “as is” based on the information you provide. We are not responsible for outcomes resulting from incomplete or inaccurate information.

14. Limitation of Liability

To the fullest extent permitted by the laws of Trinidad and Tobago, Well Rested Babies and Margaretha Grosberg shall not be liable for any indirect, incidental, special, or consequential damages arising from:

• Developmental changes or regressions

• Illness or environmental disruptions

• Inconsistent implementation of the sleep plan

• Any outcome resulting from the use of our services or materials

Our total liability to you shall not exceed the total amount paid by you for the specific service giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Well Rested Babies, Margaretha Grosberg, and any associated parties from and against any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, breach of these terms, or violation of any applicable law.

16. Website Use

By accessing our website, you agree not to:

• Use the site for any unlawful purpose

• Attempt to gain unauthorized access to any part of the site or its systems

• Transmit harmful, offensive, or spam content through the site

• Use automated tools (bots, scrapers) to access the site without permission

We reserve the right to terminate or restrict your access to the website at any time and without notice.

17. Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. Well Rested Babies does not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party site.

18. Amendments

We reserve the right to update or amend these Terms and Conditions at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the updated terms.

For existing clients, material changes to service terms will be communicated directly via email.

19. Governing Law & Disputes

These Terms and Conditions are governed by the laws of the Republic of Trinidad and Tobago. Any disputes arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.

Before initiating any formal dispute, you agree to first contact Well Rested Babies in good faith to attempt to resolve the matter informally.
